- Core problem is legal, not technical.
- Attitude 1: Patents by GemStar are really weak. Ignore them, document their weaknesses.
- Attitude 2: Patents by GemStar are really strong, but are based on prior art. Document the prior art
and file for an administrative reexamination.
- Attitude 3: Patents are (maybe) strong, but were abused by GemStar. Get yourself sued and then claim antimonopolistic
behavior.
- Attitude 4: The problem is the regulator, not the regulatee. Did USPTO err in granting patents without
prior art search? Did the granting of overly generous patents have a chilling effect under the First Ammendment or
did it amount to a taking of liberty without due process?
